Owner Jackie McGuirt later died as a result of injuries sustained in the incident. Upon his death, charges against Cook were upgraded from assault and battery with intent to kill to murder.
Cook was sentenced to 45 years for murder, 25 years for armed robbery and five years for grand larceny. The sentences are to run concurrently.
The case was prosecuted by Sixth Judicial Circuit Solicitor Douglas A. Barfield, Jr. Cook was represented by attorney Jack Swerling. Circuit Court Judge Kenneth Goode presided over the trial.
According to an arrest warrant on file in the Fairfield County Clerk of Court’s office, Cook on Nov. 23, 2001 “did while armed with a handgun, enter McGuirt’s Tire Service located on Dogwood Avenue in Ridgeway, County of Fairfield and (robbed) the victim, Jackie McGuirt of a large amount of cash at gunpoint.”
The above, the warrant further reads, is based on witness statements and investigation by the Fairfield County Sheriff’s Office.
A May 2006 scheduled trial date was rescheduled until August. The August 2006 attempt to try Cook was declared a mistrial by Fifth Circuit Court Judge L.?Casey Manning.
In this instance, a mistrial is a trial that becomes invalid because of a basic prejudicial error in procedure.
